The Benefits Of Mediation

Mediation is an informal process during which a single neutral person called a mediator helps the couple reach an agreement regarding their conflict.  Mediators assist the couple in negotiations, but are not permitted to provide legal advice to the participants.  Mediators are not allowed to decide who is right or wrong, or how to resolve a dispute.  In Florida, family law mediation is governed by Rules 12.740 and 12.741 of the Florida Family Law Rules Of Procedure.

The main benefits of mediation include incurring less costs and achieving a much quicker resolution for the couple rather than proceeding to a trial by a judge.  Additionally, mediation allows the participants to create unique solutions to their specific conflicts.  At mediation, the couple is encouraged to communicate their concerns to each other in a private setting in order to find solutions that resolve their disputes.  The mediator typically assists the couple by facilitating and encouraging the sharing of ideas and goals in a neutral setting.  During a trial, the judge is required to follow Florida law and the rules of evidence and time constraints apply.

In some instances, it could take well over a year for a trial to be scheduled in a divorce proceeding.  A judge usually requires the couple to engage in extension pre-trial preparation that results in significantly higher legal fees incurred by the couple.  In Martin, Saint Lucie, Indian River and Okeechobee counties, a couple in a divorce case is required to attend mediation before proceeding to a trial by a judge.  To read more about mediation in Florida, click on the link below:
